Terms and Conditions

The following Terms and Conditions (the "Terms") constitute a contract between you, the user or your company ("you" or "your"), and Soft Pull Solutions ("Soft Pull Solutions," "we," "us," or "our"). These Terms govern your use of Soft Pull Solutions' services, software applications, communication services, networks, and websites, including but not limited to www.softpullsolutions.com (collectively referred to as the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications.

You can review the most current version of these Terms at any time on the Soft Pull Solutions website at https://www.softpullsolutions.com/tos (the "Terms Page"). Soft Pull Solutions reserves the right to update or modify these Terms at its discretion, effective immediately upon posting the updated Terms to the Terms Page. Your continued use of the Services following such updates constitutes your acceptance of the modified Terms. We recommend reviewing these Terms periodically to stay informed about any changes.

Grant of Limited License

Subject to your compliance with these Terms, including maintaining accurate registration information and paying any applicable fees, Soft Pull Solutions grants you a non-exclusive, non-transferable, revocable license to access and use the Services. All rights not explicitly granted to you are reserved by Soft Pull Solutions and its licensors. You may not:

  • Use Soft Pull Solutions’ trademarks or service marks without explicit permission.
  • Alter, modify, or obscure Soft Pull Solutions' trademarks or the Services.
  • Represent yourself as acting on behalf of Soft Pull Solutions or as a partner, affiliate, employee, contractor, or advisor of Soft Pull Solutions without explicit authorization.

Fees and Payment Terms

Soft Pull Solutions may charge fees for the Services as outlined during account registration or when changes are made to your account plan ("Fees"). You agree to pay all Fees and charges associated with your account.

Soft Pull Solutions requires Customers to maintain at least two valid payment methods on file at all times. By enrolling in the Services, Customer authorizes Soft Pull Solutions to automatically charge any payment method maintained on file for all Fees, report charges, monthly service fees, minimum usage fees, taxes, pass-through costs, late fees, returned payment fees, chargeback fees, collection costs, and any other amounts due under this Agreement.

Soft Pull Solutions may charge any payment method maintained on file for outstanding balances, regardless of the payment method originally used for prior transactions. Customer authorizes Soft Pull Solutions to retain payment methods on file and utilize such payment methods for recurring charges and unpaid balances until all amounts owed have been paid in full. If Customer provides bank account information, Customer authorizes Soft Pull Solutions to initiate ACH debit entries from the designated account for amounts due under this Agreement and represents and warrants that it is authorized to use such account.

Invoices may be provided for record keeping purposes; however, payment shall be processed automatically using the payment methods on file. If any payment is declined, returned, disputed, reversed, charged back, or otherwise cannot be successfully processed, Soft Pull Solutions reserves the right to immediately place the account on hold, suspend access to the Services, disable bureau access, or otherwise restrict account functionality until all outstanding balances have been paid and valid payment methods have been restored.

Soft Pull Solutions may also suspend, restrict, or terminate access to the Services for compliance concerns, credentialing deficiencies, audit findings, security concerns, failure to provide requested documentation, failure to complete required training, bureau requirements, or any violation of these Terms.

Customers will be billed monthly for recurring services and for reports, products, and services utilized during the previous billing period.

Customers utilizing the API are subject to a minimum usage requirement of twenty-five (25) reports per month. If fewer than twenty-five (25) reports are pulled during a month, Soft Pull Solutions may assess an API minimum usage fee as disclosed in the applicable fee schedule, order form, or service agreement.

All Fees are non-refundable unless otherwise required by law or expressly approved in writing by Soft Pull Solutions. No refunds or credits will be provided for partial months of service, unused services, setup fees, credentialing fees, inspection fees, report fees, score fees, or other services already rendered.

Soft Pull Solutions reserves the right to change published prices or the Fees associated with your account upon thirty (30) days' notice.

Any invoice not paid when due shall be considered past due. Past due amounts may be subject to a late fee of $25 for invoices under $300 and $50 for invoices of $300 or more. Soft Pull Solutions reserves the right to place an account on hold, suspend access to Services, disable bureau access, or otherwise restrict account functionality until all outstanding balances are paid in full.

Customers are responsible for any fees, costs, or expenses incurred by Soft Pull Solutions in collecting unpaid balances, including collection agency fees, attorney fees, court costs, returned payment fees, ACH rejection fees, and chargeback fees.

Minimum Duration

This Agreement shall remain in effect for a minimum of three months. All customers utilizing the API agree to a minimum of a twelve-month service agreement. Once the minimum service duration is met, services will automatically renew for successive one-month terms unless canceled in accordance with the Terms. 

Termination of Account

You are responsible for properly canceling your account. To cancel your account, you must contact our support team and provide at least 60 days’ written notice. You may receive one or two invoices following cancellation. Soft Pull Solutions reserves the right to terminate your account immediately if you breach these Terms. In the event of termination, you will not receive refunds for any prepaid Fees. Upon termination, your account will be deactivated, and all content in your account will be forfeited.

Suspension, restriction, cancellation, or termination of Services shall not relieve Customer of its obligation to pay any outstanding balances, including previously invoiced amounts, usage charges billed in arrears, recurring service fees, minimum usage fees, pass-through fees, or other amounts accrued prior to the date of suspension, cancellation, or termination.

Soft Pull Solutions reserves the right to refuse service to anyone at any time, for any reason.

Modifications to the Services

Soft Pull Solutions may modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. Soft Pull Solutions will not be liable for any modification, suspension, or discontinuance of the Services.

Limitation of Liability

You agree that Soft Pull Solutions and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or related to this agreement, including, but not limited to, damages for loss of profits, goodwill, or data. In no event will Soft Pull Solutions' liability exceed the Fees paid for the Services in the preceding month.

Please note that modifying, suspending, or canceling your account may result in the loss of content or features. Soft Pull Solutions is not responsible for any such losses.

Acceptable Use

Before pulling credit on a consumer, you must obtain explicit consent from the individual, either through a written or electronic signature. You are required to maintain a record of this consent for at least five years. If a consumer's credit report is pulled again after a reasonable period, new consent must be obtained.

Prohibited Use

Soft Pull Solutions does not offer Services to end users involved in certain prohibited activities, including but not limited to:

  • Adult entertainment service of any kind
  • Asset location service
  • Attorney or Law Firm engaged in the practice of law, unless engaged in collection or using the report in connection with a consumer bankruptcy pursuant to the written authorization of the consumer.
  • Bail Bondsman, unless licensed by the state in which they are operating
  • Child location service (i.e. company that locates missing children)
  • Credit counseling, except not-for-profit consumer credit counseling companies
  • Credit repair clinic
  • Dating service
  • Financial counseling, except a registered securities broker dealer or a certified financial planner
  • Foreign company or agency of a foreign government
  • Genealogical or heir research firm
  • Law enforcement agency • Massage service
  • News agency or journalist
  • Pawnshop
  • Private detective, detective agency or investigative company (some exclusions may apply if such End Users are juridical persons duly organized, validly existing, and in good standing under the laws of their jurisdictions of incorporation or organization, as opposed to individuals as well as sole proprietorships, unregistered partnerships, and other organizations that are not legal entities; and is providing services to businesses, as opposed to individuals)
  • Repossession company
  • Subscriptions (magazines, book clubs, record clubs, etc.)
  • Tattoo service
  • Time Shares - Company seeking information in connection with time shares (exception: financers of time shares)
  • Weapons dealer, seller or distributor
  • Other Reseller
  • Any activities that violate the rights of others, may be harmful to others, or business, or that is illegal, including but not limited to offering, promoting, disseminating, or facilitating:
  • Gambling of any kind
  • Ponzi or pyramid schemes (get-rich-quick schemes)
  • illegal or regulated substances
  • phishing activities of any kind • pornography, child sexual abuse material, or other sexually exploitative content;
  • Content that infringes the intellectual property or rights of others
  • Communications that are harassing or abusive by nature

A complete list of prohibited activities is available in the original Terms. Violating these terms may result in immediate termination of your access to the Services.

Other Restrictions

You may not attempt to reverse-engineer, modify, or recreate the Services. Reverse engineering or unauthorized alteration of the Services is prohibited and subject to legal action.

Enforcement

Soft Pull Solutions reserves the right to monitor content and investigate potential violations of these Terms. We may remove or disable access to any account violating the Terms. However, we are not obligated to monitor or enforce compliance.

Compliance Resources

Users should be familiar with the Fair Credit Reporting Act and can refer to resources from the Consumer Financial Protection Bureau (https://www.consumerfinance.gov/learnmore/) for more information.

Privacy Policy

We take privacy seriously and only collect personal data necessary for providing the Services. By using the Services, you consent to the collection, storage, and processing of your information, as outlined in our Privacy Policy. https://www.softpullsolutions.com/privacypolicy

Soft Pull Solutions may share personal data with third-party vendors to assist with payment processing, analytics, account management, and other related services. We ensure that these third parties adhere to similar privacy protections.

Cookies

By using the Services, you consent to the use of cookies and other tracking technologies to operate, customize, and improve the Services.

Third-Party Services

We may share or collect your data with third-party service providers who assist with business operations. These providers are contractually obligated to protect your data and use it only for services provided on our behalf.
